Terms of Service

The legally binding terms that govern your access to and use of the CurrenSea over-the-counter platform.

01.Acceptance of Terms

These Terms of Service (“Terms”) constitute a binding agreement between you (“you,” “user,” or “customer”) and CurrenSea (“CurrenSea,” “we,” “our,” or “us”) governing your access to and use of currensea.in, the CurrenSea over-the-counter (OTC) trading platform, embedded Web3 wallet functionality, and any related APIs, mobile experiences, or services (collectively, the “Services”).

By creating an account, connecting a wallet, placing a Buy, Sell, or Swap order, or otherwise using any part of the Services, you confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any supplemental policies published on the platform. If you do not agree, you must stop using the Services immediately.

02.Eligibility & Account Verification

To open and operate a CurrenSea account, you must:

  • Be at least 18 years of age and legally competent to enter into a binding contract under the Indian Contract Act, 1872 (or the equivalent law of your jurisdiction).
  • Act on your own behalf, or as a duly authorized representative of a corporate entity, partnership, or proprietorship.
  • Successfully complete our Know-Your-Customer (KYC) or Know-Your-Business (KYB) verification, including PAN, Aadhaar, liveness capture, and (for corporates) CIN, GSTIN, and ultimate beneficial ownership (UBO) disclosure.
  • Clear sanctions, politically exposed person (PEP), and Anti-Money-Laundering (AML) screening performed by CurrenSea or its accredited partners.

CurrenSea may, at its sole discretion, refuse, restrict, suspend, or terminate any account that fails verification, submits falsified or tampered documents, triggers risk alerts, or is linked to previously banned users or wallet addresses.

03.Scope of Services

Through CurrenSea you may access:

  • Buy, Sell, and Swap Orders

Request a locked quote to buy USDT with INR, sell USDT for INR, or swap between supported stablecoins. Quotes are indicative until the corresponding bank-rail payment or on-chain transfer is confirmed within the stated validity window.

  • Bank-Rail Settlement

INR settlement is executed through IMPS, NEFT, or RTGS between your verified Indian bank account and the CurrenSea settlement account displayed on the order page. Payments from unverified or third-party accounts may be rejected and refunded net of applicable charges.

  • Non-Custodial Wallets

CurrenSea provisions embedded Web3 wallets via Privy and supports externally linked wallet addresses. Digital assets are released directly to the wallet address you nominate — CurrenSea does not custody user funds beyond the brief settlement window required to execute an order.

  • Verification, Compliance & Support

KYC, KYB, bank account verification, wallet-address whitelisting, concierge support tickets, order history, and tax-ready invoices are provided as part of the Services.

  • Referrals & Rewards

You may participate in the CurrenSea referral program subject to the specific referral terms published on the platform. Rewards are discretionary, may be clawed back for abuse, and do not constitute an investment or financial return.

Available assets, trading pairs, order limits, bank rails, and settlement timelines may change from time to time without prior notice to reflect regulatory, liquidity, or operational conditions.

04.Orders, Pricing & Settlement

When you place an order on CurrenSea, the following rules apply:

  • Each order displays an indicative price, applicable taxes (including GST where applicable), network fees, and an estimated settlement window at the time of placement.
  • You must transfer the exact INR amount shown on the order page from your verified bank account within the stated validity window and upload a legible payment proof (bank slip or UTR screenshot) via the CurrenSea interface.
  • Orders are executed only after successful reconciliation of the bank credit and verification of your payment proof. Partial payments, mismatched UTRs, or payments from unverified accounts may delay or void the order.
  • Digital-asset legs are released to the wallet address you have whitelisted on your CurrenSea profile. You are solely responsible for ensuring the correctness of the destination address and selected network.
  • Due to blockchain finality, on-chain transfers to incorrect or non-recoverable addresses are irreversible. CurrenSea will make reasonable efforts to assist but cannot guarantee recovery.

05.Risk Disclosure

Trading in virtual digital assets involves significant risk. By using CurrenSea, you acknowledge and accept:

  • Market & Price Volatility

Exchange rates between INR and stablecoins such as USDT are influenced by global liquidity, de-pegging events, counterparty exposure, and macro factors. Quoted prices may fluctuate between quote and settlement.

  • Blockchain Finality

Once a transaction is confirmed on-chain, it cannot be reversed. CurrenSea has no ability to recall assets sent to an incorrect, incompatible, or compromised wallet address.

  • Regulatory Risk

Laws relating to virtual digital assets (VDAs), taxation (including 1% TDS under Section 194S and 30% tax under Section 115BBH), and FIU-IND reporting may change. New restrictions may impact your ability to trade.

  • Operational & Banking Risk

Settlements may be delayed by bank outages, RBI maintenance windows, holiday schedules, blockchain network congestion, or compliance holds required by law enforcement.

  • Wallet Security Risk

If you lose access to your externally linked wallet or compromise the authentication methods tied to your embedded wallet, the associated digital assets may be unrecoverable. CurrenSea has no custody of your private keys or seed phrases.

You confirm that you are trading using your own funds, understand these risks, and are not relying on CurrenSea for investment, financial, legal, or tax advice.

06.Account Security & Credentials

You are responsible for safeguarding your CurrenSea login credentials, embedded wallet authentication method, device security, and the private keys or recovery phrases associated with any externally linked wallet. Activity performed through your authenticated session is presumed to have been authorized by you.

CurrenSea staff will never ask you for your password, OTP, PIN, seed phrase, or private key. If you receive such a request, do not respond and report the incident immediately to support@currensea.io.

You must notify CurrenSea without delay if you suspect unauthorized access, device compromise, phishing attempts, or any security incident involving your account.

07.Prohibited Activities

You agree not to use CurrenSea in connection with any of the following:

  • Money laundering, terrorist financing, proliferation financing, or sanctions evasion under the Prevention of Money Laundering Act (PMLA), 2002, UAPA, and applicable international sanctions regimes.
  • Depositing funds from, or withdrawing funds to, bank accounts or wallet addresses that you do not legally own and control.
  • Submitting forged, manipulated, or recycled payment proofs, KYC/KYB documents, or source-of-funds declarations.
  • Engaging in wash trading, market manipulation, structuring, or layering intended to obscure the origin of funds.
  • Circumventing CurrenSea security controls, bot and rate-limit protections, geofencing, or user bans — including the use of VPNs, proxies, or mule accounts.
  • Reverse engineering, scraping, or performing unauthorized penetration testing against the platform or its APIs.
  • Any activity that violates applicable Indian law, the laws of your jurisdiction, or the terms of our banking, liquidity, or infrastructure partners.

Violation of this section may result in immediate suspension, account closure, forfeiture of pending orders, reporting to FIU-IND and law enforcement, and civil or criminal liability.

08.Fees, Taxes & Deductions

CurrenSea discloses applicable fees — including trading spread, platform fee, blockchain gas fees, and refund-processing fees — on the order confirmation screen before you authorize execution. Fees are subject to change based on market conditions and partner-rate revisions.

You are solely responsible for determining and discharging any tax liabilities arising from your trading activity, including 1% TDS under Section 194S of the Income Tax Act, 1961, the 30% tax on income from virtual digital assets under Section 115BBH, and GST on service fees where applicable. CurrenSea may issue consolidated statements but does not provide tax advice.

09.Cancellation, Refunds & Chargebacks

You may request cancellation of an order only before the corresponding bank payment is initiated. Once an order moves into the awaiting-settlement or on-chain-release stage, it cannot be unilaterally cancelled.

Approved refunds, if any, will be processed exclusively to the originating verified bank account, net of applicable processing fees, network charges, and foreign-exchange or stablecoin price differentials incurred by CurrenSea. Fraudulent chargebacks or payment reversals initiated without legitimate cause will be treated as a material breach of these Terms and may be reported to banking partners and regulators.

10.Suspension & Termination

CurrenSea may suspend or terminate your access to the Services, in whole or in part, with or without notice, if:

  • You breach any provision of these Terms or applicable law.
  • Required by a competent court, regulator, or law enforcement authority.
  • Our risk, compliance, or fraud systems flag suspicious activity associated with your account, bank, or wallet.
  • You remain inactive for an extended period or fail to complete periodic re-KYC obligations.

You may close your CurrenSea account at any time by contacting support, subject to the completion of all pending orders and our statutory record-retention obligations under PMLA.

11.Intellectual Property

The CurrenSea name, logo, user interface designs, source code, product documentation, graphics, and all related intellectual property are owned exclusively by CurrenSea or its licensors. Subject to your compliance with these Terms, CurrenSea grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Services for your own personal or internal business purposes.

You may not copy, modify, distribute, publicly display, sell, sublicense, or create derivative works from any part of the Services without CurrenSea's prior written consent. All rights not expressly granted are reserved.

12.Disclaimer & Limitation of Liability

The Services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, CurrenSea disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, uninterrupted availability, and non-infringement.

CurrenSea, its affiliates, officers, employees, and partners shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages — including loss of profits, data, goodwill, or digital assets — arising from blockchain outages, forks, stablecoin de-pegging, banking downtime, incorrect wallet addresses provided by you, third-party processor failures, market volatility, or events of force majeure.

To the extent liability cannot be excluded by law, CurrenSea's aggregate liability for any claim arising out of or in connection with your use of the Services shall not exceed the total platform fees actually paid by you to CurrenSea in the three (3) months immediately preceding the event giving rise to the claim.

13.Governing Law & Dispute Resolution

These Terms, and any dispute or claim arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the laws of India, without regard to its conflict-of-laws principles.

The parties shall first attempt to resolve any dispute amicably through good-faith negotiation. If the dispute is not resolved within thirty (30) days of written notice, it shall be referred to and finally resolved by binding arbitration under the Arbitration and Conciliation Act, 1996, by a sole arbitrator mutually appointed by the parties. The seat of arbitration shall be Bengaluru, Karnataka, and the proceedings shall be conducted in English.

Subject to the arbitration clause above, the competent courts at Bengaluru, Karnataka, India shall have exclusive jurisdiction over any matter arising from or related to these Terms.

14.Changes to these Terms

CurrenSea may update these Terms from time to time to reflect product changes, regulatory updates, or operational requirements. The revised version will be published on this page with an updated “Last Updated” date.

Material changes will be notified to you via email or an in-app notice. Your continued use of the Services after the effective date of a revision constitutes your acceptance of the updated Terms.
